Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Recovery Club America LLC, doing business as MindClub America, together with its subsidiaries and affiliated programs (including InHome Recovery) ("MindClub," "we," "us," or "our") governing your use of our mobile applications, websites, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and HIPAA Notice of Privacy Practices.

Not for emergencies

The Service is not for medical emergencies or crisis situations. If you are experiencing a medical emergency, are in crisis, or are thinking about harming yourself or others, call or text 988 (Suicide & Crisis Lifeline), call 911, or go to the nearest emergency room immediately. The Service does not provide emergency or crisis intervention and is not a substitute for emergency services.

1. Description of the Service

MindClub offers:

  • Self-guided wellness tools – journaling, mood and sleep tracking, habit tracking, mental-fitness plans, and self-assessment questionnaires;
  • An educational content library – videos and learning activities;
  • Community features – discussions and events; and
  • Care and therapy features – connecting eligible users with licensed and pre-licensed mental-health providers and licensed medical practitioners for assessments, therapy, counseling, and medication management (including medication-assisted treatment). Most care is delivered via telehealth (video or phone); some services are offered in person or in your home depending on location, including in-home drug & alcohol treatment through our affiliated programs. Includes appointment scheduling, secure provider messaging, and related care coordination (which may integrate with a provider's electronic health record system).

We may add, change, or remove features at any time.

2. Nature of Services; Medical Disclaimer

The self-guided tools, educational content, assessments, and community features are provided for general wellness and informational purposes and are not medical advice, diagnosis, or treatment. They do not create a provider-patient relationship.

Therapy and care services are provided by licensed and pre-licensed mental-health providers (under appropriate supervision) and licensed medical practitioners, who may be either employees or independent contractors of MindClub and its affiliated programs. Those providers are solely responsible for the care they deliver. A provider-patient relationship is formed only when you are accepted into care by a provider.

Self-assessment scores and any risk indicators generated by the Service are screening aids only and are not a clinical diagnosis. Always seek the advice of a qualified health professional with questions about a medical or mental-health condition.

3. Eligibility and Age

You must be at least 18 years old to create an account and use the Service yourself. We provide services only to individuals aged 13 and older, and we do not provide services to – or knowingly collect information from – children under 13.

Care for a minor (ages 13–17) is arranged by the minor's parent or legal guardian by contacting us at (833) 833-9655. The parent or legal guardian provides signed consent for the minor's treatment and agrees to these Terms on the minor's behalf, the minor signs an age-appropriate assent, and the parent or legal guardian is responsible for the minor's care arranged through the Service.

You represent that the information you provide is accurate and that you are legally able to enter into these Terms.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Authentication is handled by our own authentication system. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security or safety risk.

Before receiving care, you will be asked to review and sign an informed consent for treatment (covering telehealth and the care you receive). Most care is delivered via telehealth (video or phone); some services are provided in person or in your home depending on location.

Cancellations and no-shows. Please cancel or reschedule at least 24 hours before your appointment; a $45 fee applies to late cancellations and no-shows. Cancelling less than 24 hours before your appointment results in a charge to you and lost appointment time for your clinician and MindClub. These terms are also stated in your treatment consent.

6. Fees and Payments

Fees may apply for clinical services (such as appointments and treatment). By providing a payment method, you authorize us to charge the card on file for the services you receive, consistent with your signed payment authorization; a $45 fee applies to late cancellations and no-shows (see §5). Billing for clinical/therapy services is handled through the provider's billing/EHR system. Any platform payments are processed by our payment processor (Stripe). We do not store your full payment-card details.

Refunds. Fees for services that have already been rendered (for example, a therapy appointment that has taken place) are non-refundable, except where required by law.

7. User Content and Conduct

You retain ownership of content you create (such as journal entries, posts, and comments). You grant MindClub a limited license to host, store, and process your content solely to operate and improve the Service. You agree not to: post unlawful, harassing, or harmful content; impersonate others; infringe intellectual-property rights; attempt to access data you are not authorized to access; or disrupt or misuse the Service. We may moderate, remove, or restrict content and may suspend accounts that violate these rules. The standards that apply to community features are described in our Community Guidelines.

8. Intellectual Property

The Service, including its software, content library, designs, and trademarks, is owned by MindClub or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

9. Third-Party Services

The Service integrates with third-party services (such as payment, EHR, e-signature, and notification providers). Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.

10. Privacy

Your use of the Service is subject to our Privacy Policy and, with respect to Protected Health Information, our HIPAA Notice of Privacy Practices. Please review them to understand how we handle information.

11. Disclaimers and Limitation of Liability

Disclaimer of warranties. Except as required by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability. To the maximum extent permitted by law, MindClub will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. These limitations do not apply to the extent prohibited by applicable law.

12. SMS / Text Messaging Terms

By providing your mobile number and opting in, you consent to receive text messages from MindClub.

  • Types of messages: informational (such as appointment reminders), support responses, and – only if you have opted in – marketing messages.
  • Message frequency: varies based on your activity and is not fixed.
  • Charges: message and data rates may apply; you are responsible for any carrier charges.
  • Opt out: reply STOP at any time to stop receiving messages; you will no longer receive messages unless you re-enroll.
  • Help: If you are having a mental health emergency, call 988 immediately. Reply HELP, call (833) 833-9655, or email [email protected] for assistance.
  • Delivery: Carriers are not liable for delayed or undelivered messages.
  • Eligibility: The SMS program is intended for users 18 years of age or older.

You can also manage notification preferences (appointment reminders, daily messaging, SMS, and email) in your account settings.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive. Termination of your account does not affect retention of health records required by law (see the Privacy Policy and Notice of Privacy Practices).

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Williamson County, Tennessee, and you consent to the personal jurisdiction of those courts. Nothing in these Terms prevents either party from bringing a qualifying claim in small-claims court.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, where required, provide additional notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
